Service Agreement & Accident Waiver

Please read this Service Agreement, Accident Waiver and Release of Liability completely. You will need to accept and sign this prior to your trip. You may simply print this page and bring it with you the first time we meet.

ANYONE REQUIRED TO HAVE A FISHING LICENSE MUST HAVE ONE! Please note if you are required to have a fishing license (for the state we are fishing) you must have it in your possession (and present it) before we leave. You can get your license online or anywhere state fishing licenses are sold. We can recommend Hook 'em & Cook 'em Outfitters (302) 539-6243 in Bethany Delaware. We would be happy to meet you there to assist if you like.
We only keep fish we eat! They will be cleaned and iced before we leave the fishing area. Size limits are strictly enforced. While it may be legal to fish and keep certain types of sharks we DO NOT target and we NEVER keep any sharks regarless of the species or sizes caught - no exceptions.
*There is an additional $50 for each person over two (any age). Maximum capacity 4 persons. Gratuities are not included, however greatly appreciated (especially for assistants). You may pay with credit card by using Venmo or PayPal. A $50 deposit is required to reserve your day. Balance is due prior to the trip. We will be happy to meet you at Hook 'em & Cook 'em Outfitters a day or two before to help you with licensing or just a quick meet and greet :)
Rain Days. Fish don't mind if its raining :) Some of the best fishing I have had was on windy rainy days. We will fish in "light" rain (sprinkling, misting, etc.) Thunderstorms and/or any sign of lighting and we are out of there! In the event we need to cancel due to weather, you may elect another rain day or receive a pro-rated refund of all fees/deposits based on the time already spent on the beach. You may cancel anytime up to 14 days before the trip and get 100% of all fees/deposits returned. After that first 14 days (2 weeks) the deposit is non-refundable.
Water Access. We do not allow swimming in the water where we are fishing. This is for obvious reasons. Fishing hooks hurt and fishing line can actually cut like a razor. Therefore no one (any age) will be allowed to play, swim or go in the water anywhere near the fishing lines. When a fish is hooked up, everyone within at least a 100 yards (depending on the time of year) must get out of the water immediately.
CHILDREN MUST BE SUPERVISED BY AN ADULT AT ALL TIMES AND MUST FOLLOW ALL INSTRUCTIONS FROM THE ADULT AND OUR STAFF! Any persons of any age, that can not, do not, or will not follow the rules and instructions - are not welcome and will be cause of immediate departure from the beach without refund. Fishing is fun and exciting but only when rules are followed as there are inherent dangers involved all the time! Sharp hooks, sharp knives, fishing lines that can cut through skin like butter, not to mention, sharks, stingrays, exotic species, eels, jellyfish, etc. Any unruly (or intoxicated) persons of any age will be grounds for cancellation without refund and immediate departure from the beach.
I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
I certify that I am physically fit, and am sufficiently prepared for participation in this activity, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.
I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity.
In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
- I WAIVE, RELEASE, AND DISCHARGE Fishing with Greg, and/or their owners, investors, directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity.
- I HEREBY INDEMNIFY, AND HOLD HARMLESS, Fishing with Greg, and/or their owners, investors, directors, officers, employees, volunteers, representatives, and agents, and the activity holders, sponsors, and volunteers from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.
I acknowledge that Fishing with Greg, and/or their owners, investors, directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.
I acknowledge that this activity may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, water, waves, condition of participants, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, monitors, and/or producers of the activity. These risks are not only inherent to participants, but are also present for staff, assistants, and/or volunteers.
I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.
I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by Fishing with Greg, the activity holders, producers, sponsors, organizers, and assigns.
The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
